Terms & Conditions of Hire

Redbourn Hire Co. Ltd

These Terms and Conditions apply to the hire of all equipment supplied by Redbourn Hire Co. Ltd (“the Company”) to the customer (“the Hirer”).

1. Definitions

Equipment – Any item hired by the Company including tools, machinery, access equipment, trailers and accessories.

Hire Period – The period from the time the equipment leaves the Company’s premises until it is returned and accepted by the Company.

Hirer – The individual or business hiring equipment from the Company.

2. Hire Charges

2.1 Hire charges begin from the time the equipment leaves the Company’s premises.

2.2 Charges continue until the equipment is returned and accepted by the Company.

2.3 Minimum hire periods may apply depending on the item.

2.4 Late returns may incur additional hire charges at the Company’s standard rate.

2.5 Delivery and collection charges may apply where applicable.

3. Payment Terms

3.1 Payment is due in advance unless a credit account has been approved.

3.2 The Company may require a security deposit prior to releasing equipment.

3.3 Deposits will be refunded once the equipment is returned and inspected, subject to any deductions for damage, cleaning, or missing parts.

3.4 The Company reserves the right to charge interest on overdue invoices in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

4. Hirer Responsibilities

The Hirer agrees to:

4.1 Use the equipment only for its intended purpose.

4.2 Ensure all operators are competent and appropriately trained.

4.3 Comply with all relevant legislation including the Health and Safety at Work etc. Act 1974.

4.4 Take reasonable care of the equipment at all times.

4.5 Not sell, modify, repair, or sub-hire the equipment without written permission from the Company.

4.6 Ensure equipment is stored securely when not in use.

5. Damage, Loss or Theft

5.1 The Hirer is responsible for the equipment during the entire hire period.

5.2 The Hirer shall pay for:

Damage to equipment

Loss of equipment

Theft of equipment

Missing accessories or parts

5.3 In the event of theft, the Hirer must report the matter to the police and provide a crime reference number.

5.4 The Company reserves the right to charge the replacement value of any equipment that cannot be repaired.

6. Breakdown and Faults

6.1 The Hirer must notify the Company immediately if equipment becomes faulty.

6.2 The Hirer must stop using the equipment once a fault is identified.

6.3 The Company will make reasonable efforts to repair or replace equipment as soon as practicable.

6.4 The Company shall not be liable for any loss or costs arising from equipment failure.

7. Inspection and Acceptance

7.1 Equipment is deemed accepted by the Hirer upon delivery or collection.

7.2 The Hirer must notify the Company immediately if equipment appears damaged or incomplete.

7.3 The Company may inspect equipment during the hire period.

8. Cleaning Charges

8.1 Equipment must be returned in a clean condition.

8.2 Excessively dirty equipment may incur cleaning charges.

9. Fuel and Consumables

9.1 Equipment supplied with fuel must be returned with the same level of fuel.

9.2 Fuel shortages may be charged at the Company’s current fuel rate.

10. Delivery and Collection

10.1 The Hirer is responsible for ensuring safe access to the delivery location.

10.2 The Company is not responsible for delays caused by site conditions or access issues.

11. Liability

11.1 The Company shall not be liable for any indirect or consequential loss including:

Loss of business

Loss of profits

Project delays

11.2 Nothing in these terms limits liability for death or personal injury caused by negligence.

12. Insurance

12.1 The Hirer is responsible for ensuring equipment is adequately insured during the hire period.

12.2 The Company may offer optional damage waiver or insurance where available.

13. Termination of Hire

The Company may terminate the hire immediately if:

  • Terms are breached
  • Payment is overdue
  • Equipment is misused
  • The Company believes equipment is at risk

The Company may recover equipment without notice.

14. Title of Equipment

Ownership of all equipment remains with Redbourn Hire Co. Ltd at all times.

15. Governing Law

These terms are governed by the laws of England and Wales.
